Democracy in South Africa is at risk. Although our Constitution and other laws are in place to guarantee our hard-earned freedom, there remains uncertainty that government will comply with the law and ensure legislation enacted complies with our Constitution.
The Make a Difference Trust exists to fund legal action brought to uphold freedom, democracy and the rule of law. It serves as a vital safeguard that can respond to any unlawful exercise of power, fight corruption and challenge poor decisions by government.

The Electoral Court confirmed that the decision taken by the Independent Electoral Commission (IEC) not to allow voting overseas at consulates headed by honorary consuls should be set aside. This is an enormous victory for the more than 40,000 South Africans living in Perth, as well as other cities where this judgment will be effective.
The Constitutional Court handed down judgement to compel the ANC to make public its complete cadre deployment records dating back to 1 January 2013, when President Cyril Ramaphosa became chairman of the Deployment Committee. The ANC was ordered to release unredacted records, including draft minutes, notes and attendance records.
The Supreme Court of Appeal upheld the Gauteng High Court's finding that former President Jacob Zuma's medical parole was illegal. This ruling upholds the principle that no one is above the law and that powerful individuals will be held to account.
The constitutional challenge to the Employment Equity Amendment Act questions the legality of enforcing demographic quotas and whether such measures respect the Constitution’s values of dignity, equality, and fairness. The litigation aims to ensure redress laws are proportionate and uphold constitutional principles, aligning with the Trust’s mission to support legality and the Rule of Law.
The legal challenge to the Expropriation Act highlights flaws in the process, particularly the irrational 180-day time limit tied to events that occur only after a court ruling. The Act also lacks a clear deadline for disputing expropriations, effectively allowing indefinite delays in seeking court intervention. This undermines constitutional rights. The litigation supports the Trust’s mission to defend public interest and uphold constitutional principles.
